At Clearance Kings Gold Coast, we aim to provide safe and professional delivery services. To ensure clarity and fairness for both parties, the following terms outline our delivery conditions and liability limitations.

 

 

 

 

1. Purpose of This Agreement

 

 

This Delivery Liability Agreement explains the responsibilities of both Clearance Kings Gold Coast (“the Company”) and the Customer prior to and during delivery.

 

By proceeding with a booking or delivery, the Customer acknowledges and accepts the terms below.

 

 

 

 

2. Customer Responsibility for Access

 

 

The Customer is responsible for ensuring that the delivery location provides safe, clear, and adequate access, including:

 

  • Doorways, stairways, hallways, and entrances

  • Internal areas, tight corners, and confined spaces

  • Lift access (where applicable)

 

 

If access is narrow, obstructed, restricted, unsafe, or high-risk, the Customer accepts all associated risks.

The Company reserves the right to refuse delivery or place items at the nearest safe location if access is deemed unsafe.

 

 

 

 

3. Liability for Property Damage

 

 

To the fullest extent permitted by law, the Company is not responsible or liable for any damage to the Customer’s property, including but not limited to:

 

  • Walls, floors, ceilings, doors, frames, fixtures, fittings, stairways, cabinetry

  • Personal belongings, furniture, or household items

  • Common or shared property areas

 

 

Moving goods within the Customer’s premises is performed at the Customer’s request and risk, unless damage is directly caused by proven negligence or unsafe and unreasonable actions by delivery personnel.

 

 

 

 

4. Liability for Product Damage

 

 

The Company takes reasonable care when transporting and handling items. However, liability for damage to products during delivery is limited.

 

The Company is not liable for product damage arising from:

 

  • Restricted, narrow, or difficult access

  • Customer-requested manoeuvres in high-risk areas

  • Conditions outside of the Company’s control

  • Damage occurring after delivery is completed and acknowledged

 

 

The Company is only responsible for damage caused by proven negligence or unreasonable conduct by delivery personnel.

 

Any concerns must be raised immediately at the time of delivery.

 

 

 

 

5. Customer Acknowledgement

 

 

By proceeding with delivery, the Customer agrees that:

 

  • They have ensured safe, adequate, hazard-free access.

  • They accept risks associated with tight, restricted, or unsafe access conditions.

  • The Company’s liability is limited except where negligence is proven.

  • Delivery personnel may refuse unsafe or unreasonable instructions.

 

 

 

 

 

6. Delivery Completion

 

 

Upon completion of delivery, the Customer may be asked to confirm that:

 

  • The items were delivered as requested.

  • They have inspected the goods.

  • Any concerns have been raised immediately.
